Rada rejected the opportunity to challenge the AMCU fines in court

The draft law also establishes the right of companies to appeal against the decisions of the Antimonopoly Committee of Ukraine in court.

The bill №2431 proposed a unified system for calculating fines to eliminate discriminatory decisions of the AMCU.

The Verkhovna Rada rejected Bill №2431, which proposed to introduce the possibility for companies to challenge in court the decisions of the Antimonopoly Committee (AMCU), including the size of fines.

The bill offers a unified system for calculating fines, since now only its upper size has been established and there are no rules for calculating penalties, the explanatory note to the document says.

The purpose of the proposed changes is to provide a unified approach to determining the size of AMCU fines in order to exclude discriminatory decisions when different companies were charged for similar violations.

The draft law also establishes the right of companies to appeal against the decisions of the Antimonopoly Committee of Ukraine in court. Now there is no such option.

Recall that in January 2016, the parliament sent the bill №2431 for a second reading.
